
Family courts in America have operated under a terribly damaging assumption for far too long. With disregard for years of research and God’s Word, they have reduced the function of fathers to being primarily, if not solely, financial. This has wreaked havoc on the children of our nation. SC has an opportunity to correct this with the Equal Parenting Act, which would create a presumption of 50/50 custody, a standard supported by research as well as the Creation order.
If the family is truly the cornerstone of a society, then it follows that removing fathers would cause immense damage to that society. The statistics surrounding fatherlessness regarding incarceration, poverty, graduation rates, and addiction are alarming and irrefutable. Despite this knowledge, our current laws treat fathers as visitors, or remote revenue streams, rather than parents. In effect, this has created state-mandated fatherlessness.
Equal parenting legislation establishes the presupposition that shared parenting is in the best interest of the child. This moves the process from being focused on the rights of the parents to being focused on the well-being of the children. Furthermore, by presupposing shared custody, fathers no longer have to prove they are worthy of their own children. Instead, anyone claiming otherwise will be required to meet the burden of proof. These changes to the law will not only keep children engaged with their fathers; they are also shown to lower divorce rates, another win for our society.
Those who claim to live by a Biblical worldview are compelled to support equal parenting, not only as good public policy but as righteous judgment. If we are to have a strong society, we must value the family, and that means we cannot facilitate its destruction. South Carolina, and all states, should adopt Equal Parenting legislation and thereby make clear that fathers are a necessity, not accessories.
